TERMS & CONDITIONS
Security Policy
We have an effective security policy that we review regularly. All credit card details are processed online using PAYPAL system of payment which uses secure 128 bit encryption over an SSL (secure socket layer) connection. Credit card details are not stored after they have been processed.
Cancellation Policy
Cancellations can be made by calling us on 01455 557333 within 48 hours of placing your initial order, the order can be cancelled with all money being returned minus the credit card charge within 30 days. Unfortunately our banking service provider makes a charge for all card transactions which we bear. In the event that you cancel the order we will refund you your money less that charge.
Retail Orders
Payment by credit card, cheque, postal order or money order in advance of dispatch.
Title of Goods (retail customers)
Goods supplied by Indomie to customers remain the property of the company, until paid for in full by the customer.
Prices
Orders are subject to acceptance by the company and to availability of goods and will be invoiced at prices ruling at the time of acceptance. Indomie reserves the right to substitute products of equal or greater value to compensate for out of stock items.
Delivery/Shipping
Orders placed will be delivered within 28 days maximum, unless we have contacted you and agreed alternative terms. (Usually orders are dispatched within 72 hours of receipt of order as long as all goods are in stock, if something is out of stock we will notify you before the goods are dispatched). Alternatively you may wish to collect your order from our offices by prior arrangement.
Delivery is via standard Royal Mail letter post or Standard Parcel rate or by an elected parcel courier service and delivery time is in accordance with this. Where parcels can not be delivered a calling card is normally left and it is your responsibility to collect your items within the delivery methods specified times and within a timely manner. We will always keep proof of posting and despatch however if you require an order to be sent recorded or special delivery then you will need to contact us and additional charges will apply. Otherwise goods are sent at your own risk.
Delivery Charges
These are calculated in accordance with the weight of each individual product. Postage costs are in addition to this and are calculated by the shipments total weight. Total postage and packing costs therefore vary depending upon your order and are summarised in the final stages of the checkout. For international deliveries you should contact us for charges.

We will provide a full refund (excluding delivery charges) if the product you have selected is found to be unsuitable within 7 working days following delivery, providing the product is returned in it’s original box, in an 'as new’ and unmarked condition complete with all packaging and accessories.
No returns will be entertained unless the above conditions are strictly adhered to.
No credit or refund will be give for any goods ordered in error by the customer.
No credit or refund will be given for any losses due to the incorrect storage or merchandising by the customer, of any goods supplied by Indomie.

Complaints
If you find that you are not satisfied with any product or service please feel free to contact our customer service department at sales@indomie.co.uk. We will endeavour to resolve any claim made a soon as possible.
Mistakes in Payments
Any mistakes in payments will be rectified as soon as possible, and at the latest within 30 days of agreeing to do so.
Guarantee
All goods offered by the company are guaranteed to meet statutory requirements. However, the company cannot accept responsibility where goods supplied are subject to further processing or repackaging by the customer.
General
We accept credit card payments with most popular cards through the Paypal system.All of our food products are zero rated for VAT purposes.

Chadha Oriental Foods (we, us or our) respects your privacy and is committed to protecting your personal data. This privacy notice will provide you with information about how we look after your personal data when you visit our website (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you.
This privacy notice aims to give you information on how we collect and process your personal data through your use of this website, including any data you may provide through this website, when you contact us, when you purchase our products, or where you enter any competition, promotion or prize draw which we may run.
It is important that you read this privacy notice together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your personal data. This privacy notice supplements those other notices and is not intended to override them.
For the purpose of data protection laws in the UK, Chadha Oriental Foods is the data controller and is therefore responsible for your personal data.

- Identity Data includes first name, middle name, last name, title, date of birth, gender and employer.

- Financial Data includes bank account and payment card details.
- Transaction Data includes details about payments to and from you and other details of products you have purchased from us.
- Profile Data includes, in relation to your website account, your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
- Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
- Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-
in types and versions, operating system and platform and other technology on the devices you use to access our website. - Usage Data includes information about how you use our website, products and services.
Personal data does not include data where your identity has been removed or which not associated with or linked to your personal data (anonymous data).
We may also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.
Please note that where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with products that you request). In this case, we may not be able to accept your order but we will notify you if this is the case at the time.
2. How we collect personal data
We use different methods to collect data from and about you including through:
· Direct interactions. You may give us your Identity, Contact and Financial Data by filling in forms, by corresponding with us by post, phone, email, via our website or otherwise, or when you enter into a contract with us for the provision of our services.
· Automated technologies or interactions. As you interact with our website, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, [server logs] and other similar technologies.
3. The purposes for which we use personal data
We will only use your personal data when the law allows us to. We may collect and process the personal data about you for the following purposes:
- Contacting us -
when you contact us with an enquiry or to request information about our products, we will use your Identity and Contact Data to respond to you in accordance with our legitimate interest of maintaining our goodwill and reputation as well as ensuring good customer relations,. - Newsletter Sign-
up – in accordance with our legitimate interests of promoting our business and maintaining good customer relations when you sign up to receive our newsletters we will use your Identity and Contact Data to provide you with that newsletter. - Competition Entries – when you enter any competition, prize draw or promotion which we run we will use your Identity and Contact Data to contact you in respect of that competition, prize draw or promotion and to notify you if you have won as part of our performance of our contract with you and in accordance with our legitimate interests of maintaining good customer relations and developing and growing our business.
- Website account -
when you sign up for an account on our website, we will need your Identity and Contact Data so that we can identify you as an account holder. You will also be asked to create Profile Data including a username and password. Your account will also hold details of previous purchases or orders made by you (Transaction Data), and any preferences that you set for your account (Marketing and Communications Data). This information is necessary for the performance of our contract with you and is in accordance with our legitimate interest of maintaining good customer relations and ensuring the smooth running and operation of our business. - Ordering our products and services -
we will use your Identity, Contact, Financial and Transaction Data in order to register you as a customer and to process and deliver products to you, including the management of payments, fees and charges. This is necessary for the purpose of performing our contract with you. - Advertising, marketing and public relations -
we may use the Identity, Contact, Technical, and/or Usage Data of our customers to form a view on what we think our customers may want or need, or what may be of interest to them and in doing so we will only send information that is deemed relevant to their use of our services. This is necessary for our legitimate interests in growing and developing our business including our products and services. Customers will receive marketing communications from us in relation to similar products to those which they have previously purchased and where they have not opted out of receiving that marketing. Where we process personal data on the basis of a legitimate interest, as set out in this privacy notice, legitimate interest means the interest of our business in conducting and managing our business to enable us to give you the best service and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). - On occasion, we need to hire other companies to help us to serve you better and in some of these cases we may need to share personal data that is necessary to perform tasks for us, such as courier and delivery companies or companies engaged to run promotions on our behalf.
- Where it is necessary for the performance of our contract with you, including where you have asked us to do so or where we need to take steps to enforce any contract which may be entered into between us.
- To our parent company GraceKennedy Limited as part of the shared support services which they provide and for the proper administration of the group including product development and improvement.
- Where we are under a legal duty to do so in order to comply with any legal obligation.
- In order to protect the rights, property or safety of our business, our employees and workers, customers, suppliers and others. This includes exchanging information with other companies and organisations for the purposes of fraud prevention and credit risk reduction.
- If we or substantially all of our assets are acquired by a third party, in which case personal data that we hold about our customers will be one of the transferred assets.
We require all third parties that process personal data on our behalf to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
5. Security
We are committed to ensuring that your personal data is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal data we collect. In addition, the access to and use of the personal data that we collect is restricted to our employees who need the personal data to perform a specific job role or activity. Where personal data is shared with third parties in line with this privacy notice responsible measures are used to protect your personal data.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
The transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website; any transmission is at your own risk. 6. International transfers
Our parent company GraceKennedy Limited is based outside the European Economic Area ("EEA") and in certain circumstances it may be necessary for your personal data to be processed by GraceKennedy Limited or by another member of the Grace Kennedy Group of Companies, such as where you have an account with us, make a compliant in respect of a particular product, raise an enquiry with us or where this is necessary for the proper administration of the group including product development and improvement. Their processing of your personal data will involve a transfer of data outside the EEA.
Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

up communications from you or to ensure that we are in possession of all relevant papers in the event of a legal claim relating to the contract between us.
